Before you can use the ASDA Scan and Go service, you must agree to these Terms and Conditions. This creates a legal agreement between you and us. After initial registration, your continuing use of the service reconfirms your acceptance of these Terms and Conditions so if you do not agree with anything in this document, you must not register for or use the Scan and Go service. To help make these Terms and Conditions clearer, we use 'ASDA' or 'us' or 'we' to refer to Asda Stores Limited of South Bank, Great Wilson Street, Leeds, LS11 5AD and we use 'you' or 'your' to refer to the user of this service. The Scan and Go service is free for all ASDA customers, subject to acceptance of and compliance with these Terms and Conditions.
ASDA is entitled to withdraw your right to use the Scan and Go service at any time if you do not comply with these Terms and Conditions. If we do that, the legal agreement created between ASDA and you under these Terms and Conditions will come to an end immediately, although any relevant statutory rights that you may have will not be affected. More generally, ASDA reserves the right to withdraw the Scan and Go Service at any time, at its sole discretion.
You are entitled to stop using the Scan and Go service at any time, although the legal agreement created between you and ASDA under these Terms and Conditions will continue until we receive a written notification of your intention to bring that agreement to an end at the above ASDA address.
As part of the Scan and Go registration process you will need to confirm that you are over the age of 18 and you must provide your name; the first line of your address; your postcode; your date of birth; your email address; and a valid UK telephone number. A member of staff will be available to assist you with the registration process.
You agree to use the scanner to scan all items you wish to purchase as you move around the store. You also agree to pay for those items at the designated Scan and Go payment area. If you have any difficulties in scanning an item, you must tell a member of staff at the payment area and he or she will assist you. Staff will be available to assist with any vouchers and other promotions you may wish to use when paying for your items. Please be aware that the savings associated with any in-store offers may not be shown at the time that you scan the item concerned, but should appear when you check out your purchases. In addition, the way in which savings are deducted using the Scan and Go service may mean that the total price displayed on the scanner differs from the total price payable when you check out in the payment area. If that happens, the amount displayed in the Scan and Go payment area will be the full amount payable for your selection of goods. Again, if you have any problems, you must tell a member of staff and he or she will assist you. By using the scanner, you agree that you will use that device to purchase all of your shopping for that visit. If you want to buy additional goods without using the Scan and Go service, you must pay for the goods scanned by the device first and then you will be welcome to re-enter the store to buy more goods without using the Scan and Go service. ASDA reserves the right to report any suspected abuse of the Scan and Go service to the police and/or to instruct a debt recovery agent to seek payment from you on ASDA's behalf.
Age restricted items (e.g. alcohol) may be scanned and added to your trolley. When you get to the self-checkout a member of staff will be alerted to come and approve any age restricted items. In most stores, loose items (e.g. fruit and vegetables) should be weighed on the scales provided within the fruit and veg section. You should print out a barcode, attach this to the item and scan it as normal. Alternatively, and in stores where there are no facilities to weigh loose items and print out barcodes, you can weigh and scan these items at the self-checkout. Items with a security tag may be scanned and added to your trolley, but you will need to ask a member of staff to remove the tag at the Scan and Go payment area.
As a user of the Scan and Go service, we may ask you to help us confirm that the service is working effectively by allowing us to check your goods against the scanner or to re-scan your shopping. Please understand that this does not imply that we suspect you of any wrongdoing, it is simply to ensure that we provide the highest quality service. If there is a difference between your scan and any re-scan carried out by a member of staff, the re-scan will be decisive.
To ensure speed and ease of use, we will store your registration information on our system. That data will allow us to confirm your identity, detect and prevent crime and manage and improve the Scan and Go service. We may also analyse your information to see how you use the Scan and Go service and understand your shopping behaviour. If you have provided consent in advance, we may use your contact details and information from the Scan and Go service to send you details of ASDA offers, products and services that we think may be of interest to you and we may tell you about other organisations' products and services. If you do not wish to receive these communications, please let us know. You can change your mind at any time by contacting our Data Protection Officer at [email protected]. You can also unsubscribe by following the instructions that we will include in any communication, such as email or text, we send to you. Your personal information will be kept strictly confidential and will not be passed on to any third party, except those listed below:
a person to whom we are required or permitted to pass your data by law;

The Scan and Go service is provided on an 'as is' basis and ASDA cannot guarantee that it will be error free. If you experience any technical issues you should report them to a member of staff who will be happy to assist you. We may from time to time restrict access to the Scan and Go service to allow for maintenance, repair or renewal, but if that happens, we will do our best to have the service running as soon as reasonably practicable.
The content of the Scan and Go service is protected by copyright, trademarks, database and other intellectual property rights. You agree that you are not allowed to use any materials or content of the Scan and Go service, or permit any third party to use them, without ASDA's express permission.
The Scan and Go service is provided on an 'as is' basis. We cannot be liable for any indirect or consequential loss or damage or loss of profits or reliance arising out of your use of, or the availability or lack of availability of, the Scan and Go service. Nothing in these Terms and Conditions shall in any way limit our liability for death or personal injury resulting from our breach of contract, tort or negligence nor limit any legal rights you have as a consumer. ASDA's total liability to you in connection with these Terms and Conditions shall be limited to the purchase price of the goods you purchase.
Your use of the Scan and Go service and any dispute arising out of it is subject to the laws of England and Wales. You are not permitted to transfer or assign any of the rights granted under these Terms and Conditions. Should ASDA decide not to pursue a breach of these conditions immediately, we may decide to do so at a later date. ASDA is not responsible for any breach of these Terms and Conditions caused by unforeseen circumstances over which ASDA has no control. Should any part of these Terms and Conditions be found to be invalid, this shall not affect the validity of the remaining provisions which will remain in full force. Third parties are not entitled to enforce any of these Terms and Conditions, save where permitted under the Contracts (rights of Third Parties) Act 1999.
We may occasionally amend these Terms and Conditions so you should check them regularly when you use the Scan and Go service to ensure that you are aware of any changes. If we make a change and you do not wish to accept the new Terms and Conditions you should discontinue use of the Scan and Go service. Continued use of the Scan and Go service after the date on which the change comes into effect indicates that you agree to be bound by the new Terms and Conditions.

As part of fraud prevention, your data is used to build up a profile based on accuracy checks that are carried out – during these checks we gather data on how frequently items have not been scanned correctly whilst using the Scan & Go service. Accuracy checks are triggered based on randomised sequencing, profile history, and unexpected behaviour whilst shopping (such as high numbers of unrecognised barcodes being scanned) as a result of these checks you may be approached by one of our helpful colleagues to review your basket when you get to the till. We may also analyse your information to see how you use the Scan and Go service and understand your shopping behaviour.
